These General Terms & Conditions (referred to herein as “Terms & Conditions”) set out important information regarding your rights, obligations and the restrictions that apply when you use our online services which we make available (which includes, amongst other things, audio visual content, text, photographs, forums, blogs, forums, advertising and other services) (“Services”) at the website http://fantasygaelicsports.ie   (the “Website”).
These Terms & Conditions govern the relationship between you and Fantasy Gaelic Sports when you access and use our Website and Services. We reserve the right to update these Terms & Conditions via the Website at any time and at our sole discretion.

By accessing and continuing to use the Website, you agree to be legally bound by these Terms & Conditions – so you should read them carefully. If you do not agree with any part of our Terms & Conditions then you should immediately cease to use our Website and/or any Services.
You may be asked to agree to further terms and conditions when using specific Services for example entering competitions promoted by us or our partners on the Website, submitting materials, subions, or purchasing content or other goods via the Website. If there is any inconsistency between these Terms & Conditions and any such terms and conditions, the latter terms and conditions shall prevail.

Fair Use Policy – Restrictions on Use of the Website/Services

In accessing the Fantasy Gaelic Sports website and the material or content made available via the Website and Services, you shall only do so for your own personal, non-commercial use.
You agree to comply with these Terms & Conditions at all times when using our Services and all applicable laws and regulations, together with any specific usage rules that may be posted on the Website in relation to any material and content that you access via the Services.

All intellectual property rights in this Website and all material or content made available by Fantasy Gaelic Sports via the Website (excluding any Submissions by users (in respect of which see below) shall remain at all times the property of Fantasy Gaelic Sports. The names, images and logos identifying us, related companies, our partners or third parties and our/their products and services contained in the Website and the Services are proprietary marks and may not be reproduced or otherwise used without express permission.
Nothing contained in these Terms & Conditions shall be construed as conferring by implication any licence or right to use any trade mark, patent, design right or copyright of Fantasy Gaelic Sports or of any third party.

Notice and Take Down

We reserve the right to remove any material which is submitted by users which we believe is infringing a third party’s intellectual property rights. In the event that you believe your intellectual property rights are infringed by any material contained on the Website, then please inform us with the appropriate information to identify the material and the reasons you allege your rights are being infringed.

Registration

You may be required to register your details for certain Services and open a user account that you can then use to access and log on to use those Services. You promise to follow any specific terms and conditions that may apply to any such Service.

This Website contains links to other third party websites and services through advertising or otherwise and we have no control over those third party websites or services and are not responsible for their contents. • restrict your statutory rights as a consumer
• limit our liability for death or personal injury resulting from our negligence or for fraud

These Terms & Conditions shall not make us responsible for any damage or loss caused to you where such damage or loss is not reasonably foreseeable to you and us when you use the Services, including where the damage or loss results from our breach of these Terms & Conditions.
You agree to compensate us in respect of any damages suffered by us or any of our losses resulting from any claim made by a third party in each case in respect of any matter arising from your use of the Website and/or the Services in breach of these Terms & Conditions or from your violation of any applicable law or regulation.
You agree not to give any indication that you have any commercial relationship with us, or that you are our agent or that we have endorsed any submission you may make.

Assignment

These Terms & Conditions along with any rights and/or licenses granted, may be assigned by Us without restriction, but may not be transferred in any way or assigned by you to any third party.

Severance

If any provision of these Terms & Conditions shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these Terms & Conditions which shall remain in full force and effect.

Law and Jurisdiction

These Terms & Conditions are available in English only and shall be exclusively governed by and construed in accordance with the laws of The Republic of Ireland. Disputes arising in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the Irish courts.

Please note that we may update and amend these Terms & Conditions from time to time and any changes will be posted on the Website and it is your responsibility to check for updates. We recommend that you print and store or save a copy of these Terms & Conditions for future reference.

Message Boards

If you utilize a message board operated by Fantasy Gaelic Sports, your use of those services is governed by the Terms and Conditions attaching to those services. If you choose to publish your e-mail address or publish other personal data, you do so at your own risk.

Transfer of Data

Your data will be held in Ireland by Fantasy Gaelic Sports which includes any subsequent purchasers, successors or assigns of Fantasy Gaelic Sports. We will share non-personal information with our advertisers and business partners. Your email address may be shared with our business partners, advertisers and sponsors for the purposes of targeted marketing. We will also disclose your personal information if we are legally required to do so or if it is reasonably necessary to protect and defend the rights or property of Fantasy Gaelic Sports.
We employ other companies and individuals to perform functions on our behalf. Examples include fulfilling orders, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments, and providing customer service. These companies have access to personal information needed to perform their functions, but may not use it for other purposes.

Security

Your personal data is held on secure servers hosted by a third party. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, Fantasy Gaelic Sports cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk. Once we receive your transmission, we use our reasonable commercial efforts to ensure its security on our systems.

The Game:

The Gaelic Fantasy Sports competition (the "Game") will run from Sunday 2nd May 2010 to the completion of the final Eligible Match. "Eligible Matches" are Gaelic Athletic Association Championship matches for the 2010 season only.

1. Entry Dates:

To guarantee maximum points scoring potential, valid confirmed entries must be received by Sunday 2nd May 2010. Entries will be permitted after this time but will only score points which accrue after the date of entry.

2. Entry Qualification:

The Game is only open to those aged 18 years or over at the time of registration and is open to any eligible person residing in a country where the Game is not prohibited or otherwise unlawful. Failure to observe these requirements will mean that any potential winning entry is invalid and all winnings will be forfeited.
Entries to the Game may be made via the website of Fantasy Gaelic Sports.
In all cases, entrants must supply all the information requested. Misrepresentation or fraudulent use of a credit/debit card will invalidate a Website entry or transfer. Entrants entering by means of the Website will also incur their own cost (if any) of time spent accessing that Website.

3. Mini Leagues and Private League Bulletin Boards:

There will be the option of creating mini leagues and private leagues to enable participants to compete against friends, family, workmates.

4. Acceptance:

Entries correctly submitted through the Website will result in an acceptance message on the Website (which entrants are advised to print out and keep) containing the entrant's team name(s) and team preferences, user account and payment details. These details will be confirmed by email to the entrants email address supplied during registration (provided the entrant has correctly submitted their email address). It is the entrant's responsibility to remember and maintain the security of their password. Passwords should not be disclosed to any other person.

5. Team Names:

Fantasy League Ltd reserves the right to refuse to accept team names that are felt in its sole opinion to be inappropriate or offensive. Unsuitable names will be deleted and the team will appear under the manager's name.

6. "How to Score" rules:

Players that appear in the official Game player list will only score points for Eligible Matches.
During the Championship campaign, the fantasy hurling & football players will be allocated a point score after each game, based on their performances in the match. Only official All – Ireland Hurling & Football championship games are included. Qualifying round games will also be included. The decision of Gaelic Fantasy Sport in this regard will be final and points awarded will not be subject to appeal.

7. Prizes:

The level of  prizes will be determined by the number of entrants into the competition. There will prizes for the overall 1st,2nd,3rd,4th,5th places. There will also be prizes for the highest final point total scored in each individual county. Individuals in the top 5 will be excluded from the individual county prizes. Prizes will be mainly cash, but will also include €250 voucher from Tour America, flights from Aer Arann and Jerseys.

8. Awarding of Prizes:

The awarding of the final end-of-season prizes will take place within twenty eight days of the final Eligible Match of the season following which the winners will be notified. The judges' calculation of scores will be final and no correspondence will be entered into.

9. Contacting Winners:

Following the awarding of prizes results will be announced and all winners will be formally notified via the contact details provided on their entry form within 28 days of the announcement of the prize. If a winner cannot be located within three months of the announcement date, the prize will be forfeited. All prize winners will be announced within 14 days following the last Eligible Match of the relevant prize period. The winners agree to allow the free use of their names, photographs, general location and team name and selections for publicity and news purposes. The prizes are non-transferable and there are no alternative prizes.

Customers are legally responsible for the content of any web content they generate including, but not limited to, use of copyrighted material, posting material considered indecent for minors, or posting material in breach of the laws of this State.
